Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Pro Promptor mobile application (the "App") operated by Agency Stellia ("us," "we," or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

1. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.

2. User Accounts

To use certain features of the App, such as syncing scripts, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Subscriptions and Payments

The App is available on a freemium basis. Certain features are free to use ("Free Tier"), while access to advanced features ("Premium Features") requires a paid subscription.

  • Billing: Subscriptions are available on a monthly or annual basis. Payments will be charged to your Apple ID account at the confirmation of purchase.

  • Auto-Renewal: Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

  • Managing Subscriptions: You can manage and cancel your subscriptions by going to your App Store account settings after purchase.

  • Refunds: All purchases are final. Except when required by law, paid subscription fees are non-refundable.

4. User-Generated Content

  • Your Content: You retain all ownership rights to the scripts and other content you create, edit, or store within the App ("User Content").

  • Our License to Your Content: By using the App, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and transfer your User Content solely for the purpose of providing and operating the App's services, such as syncing your scripts across your devices.

  • Your Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you own or have the necessary licenses, rights, and permissions to your User Content and that it does not infringe on any third-party rights or violate any laws.

5. Prohibited Conduct

You agree not to use the App to:

  • Post or transmit any User Content that is unlawful, harmful, defamatory, obscene, or infringing on intellectual property rights.

  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App.

  • Interfere with or disrupt the integrity or performance of the App or its underlying services (e.g., Firebase).

  • Use the App for any purpose that is illegal or prohibited by these Terms.

6. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Agency Stellia and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without the prior written consent of Agency Stellia.

7. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

If you wish to terminate your account, you may simply discontinue using the App and can request data deletion by contacting our support.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the App is at your sole risk. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Limitation of Liability

In no event shall Agency Stellia, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country/State, e.g., France], without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
